House Bill 2195: On-site Wastewater Treatment Facilities

NEW LEGISLATION FOR THOSE WITH

ON-SITE WASTEWATER TREATMENT FACILITIES

Effective September 14, 2024

The State Legislature passed House Bill 2195 regarding on-site wastewater treatment facilities and it was signed by the Governor during this year’s legislative session. Below is a description of the bill. To see the entire bill, go to https://apps.azleg.gov/BillStatus/BillOverview?SessionID=128

Until the Arizona Department of Environmental Quality (ADEQ) revises its rules after December 31, 2024, an on-site wastewater treatment facility with a design flow of more than 3,000 gallons per day buts less than 75,000 gallons per day may discharge under a General Permit if the on-site wastewater treatment facility complies with existing General Permit rules and is operated by a service provider that is certified by the technology manufacturer. The Director of ADEQ shall include an addendum to the General Permit authorization that requires on-site wastewater treatment facilities to conduct maintenance, monitoring, record keeping and reporting in addition to the requirements of the General Permit.

For an on-site wastewater treatment facility with a design flow of 50,000 gallons per day or more or for a site with multiple on-site wastewater treatment facilities with a collective design flow of 50,000 gallons per day or more, ADEQ may require the facility to provide financial assurance.

ADEQ shall establish fees for these General Permits which shall be deposited in the Water Quality Fee Fund.

After ADEQ adopts the revised rules (which will be after December 31, 2024) for on-site wastewater treatment facilities with a design flow of #,000 gallons per day or more, permittees will have 180 days to transition their facilities to meet the new rules.
